Texas DA Accused of Manipulating Evidence to Frame Defendant in Self-Defense Case

Travis County District Attorney, José Garza, who is backed by billionaire George Soros, is facing accusations of evidence tampering and witness retaliation to falsely convict Army Sergeant Daniel Perry in a murder case involving self-defense.

Perry was driving for Uber in downtown Austin when he came across a mob of Black Lives Matter rioters, who were illegally blocking city streets. Among them was Garrett Foster, who was carrying an AK-47.

Perry’s defense team alleges that violent protesters surrounded his vehicle and began pounding on it, and Foster pointed his gun at Perry, prompting him to fire his legally carried handgun in self-defense. Perry’s lawyers now argue that Garza manipulated evidence and witnesses to secure the murder conviction.

In a letter to the Texas Board of Pardons and Paroles, Perry’s defense team presented exculpatory evidence that was not allowed to be presented to the jury by the trial judge. The lawyers also resurfaced a previously made accusation that Garza tampered with evidence prepared by the lead investigator leading up to the grand jury hearing.

Although the motion requesting an evidentiary hearing was denied, the trial judge did not rule on the allegations’ merits.
