Taxpayers would be able to challenge the Internal Revenue Service in court for breaching their rights by data gathering, according to a decision that was just handed down by the First District of the United States Court of Appeals.
The appeals court reached the conclusion that the United States District Court for the of New Hampshire had erred when it dismissed the court challenge on the grounds that it lacked jurisdiction.
The Internal Revenue Service (IRS) has, up until this point, been successful in preventing the federal courts from permitting any serious challenges to the IRS’ data-collection procedures.
