Moderna has initiated legal action against its rivals Pfizer plus BioNTech, alleging that the two companies “copied” its technologies in order to develop their coronavirus vaccine and violated patents that were associated with the vaccination procedure.
The decision was made public by the company on Friday, they stated that it would initiate legal action against Pfizer and BioNTech for copyright infringement in the USA and Germany, which is the location of the latter company’s headquarters.
“We are having to file this litigation to safeguard the groundbreaking mRNA technology platform that we pioneered, initial investment billions of dollars in creating, and patented during the decade prior to the Covid-19 pandemic,” the Chief exec of Moderna, Stephane Bancel, said in a comment. “We are filing these lawsuits to protect the innovative mRNA technology platform that we pioneered, invested billions of dollars in creating, and patented.”
The messenger RNA innovation in dispute has been in production since 2010, according to Bancel, who also mentioned that perhaps the technology got patented for the first time in 2015 for usage with coronaviruses. Pfizer and BioNTech, according to the firm, “illegally copied” Moderna’s inventions for their own goods and “continued to use them without authorization.” The company now believes this to be the case.
BioNTech, which worked in collaboration with Pfizer to develop the Comirnaty vaccine, has acknowledged the pending legal action but kept insisting that every aspect of its work is “unique” and that it will “continue to defend against every accusation of patent lawsuits.” BioNTech developed the vaccine in partnership with Pfizer.
In 2020, Moderna stated that it would not enforce any intellectual property rights linked to Covid-19 in order to ensure vaccine access. However, the company later limited this pledge to certain low-income and middle-income nations, which means that large competitors such as Pfizer could still be subject to legal action.
However, the corporation has stated that it does not intend to withdraw Comirnaty from circulation but rather seeks compensation for the claimed intellectual property violations.
Earlier this year, biotech firms Arbutus Biopharma, as well as Genevant Sciences, sued the pharmaceutical company Moderna for infringing on their patents for a vaccine delivery system. This latest lawsuit is only the latest in a long line of similar actions against the pharmaceutical industry. Moreover, German company CureVac filed a lawsuit against Pfizer and BioNTech last month for alleged intellectual property (IP) infringement, and also another firm, Alnylam, also made repeated charges against Pfizer, BioNTech, plus Moderna.
