The Chinese Communist Party (CCP) is attempting to spread its ideology and control worldwide as part of its quest for global hegemony.
While the CCP is not yet able to engage in a head-to-head military confrontation with the United States and its allies, it is using asymmetrical warfare tactics known as “three warfares”: public opinion warfare, psychological warfare, and legal warfare.
These tactics are designed to undermine and weaken the U.S. while also strengthening the CCP’s military objectives and capacity for war in multiple theaters. One tactic, known as “lawfare,” involves using the U.S. legal system to weaken America’s standing as a global superpower, by exploiting the strengths and weaknesses of American law and litigation to obstruct, divide, and undermine the U.S. both internally and on the global stage.
Lawfare is a major component of fifth-generation warfare, which uses information and data to manipulate worldviews and destroy opponents from within. It is critical that the U.S. understands and actively works to counter the CCP’s three warfares strategy in order to protect national security.
The (CCP) has been accused of using “unrestricted lawfare” to exploit and manipulate the legal system of the United States. This tactic involves using the legal system to criticize and attack opponents, while also ignoring its own legal and ethical violations. According to Dean Cheng, a former senior research fellow at the Heritage Foundation’s Asian Studies Center, this approach involves “arguing that one’s own side is obeying the law, criticizing the other side for violating the law, and making arguments for one’s own side in cases where there are also violations of the law.” The CCP has been accused of using this tactic to weaken the United States, break the will of the people, and exert its political influence beyond its own borders. It has also been accused of using the legal system to persecute Chinese dissidents on American soil and punish whistleblowers.
